ULTIMATE VILLAS BOOKING CONDITIONS

These Booking Conditions, together with our Privacy Policy, any villa information we provide and your booking confirmation, form the contract between you and The Ultimate Travel Company Limited trading as Ultimate Villas.

The Ultimate Travel Company Limited is registered in England and Wales with company number 3528325. Registered office: 10 London Mews, London W2 1HY. Office address: 25–27 Vanston Place, London SW6 1AZ.

By making a booking, the Lead Guest confirms on behalf of the entire party that:

  1. They have read and agree to these Booking Conditions.

  2. They are over 18 and have legal authority to enter into this contract.

  3. They accept financial responsibility for all payments due under the booking.

  4. They consent to the use of personal data as set out in our Privacy Policy and have authority to share the personal data of all members of the party.

1. Type of booking

We offer two types of arrangement:

• Accommodation-only villa bookings.
• Package holidays, where your villa booking is combined with flights or additional travel services in a way that meets the definition of a Package under the Package Travel and Linked Travel Arrangements Regulations 2018.

If your booking becomes a package, The Ultimate Travel Company acts as the Package Organiser and your additional legal rights are set out below:

ATOL

Your Financial Protection. When you buy an ATOL protected flight or flight inclusive package from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.

We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be reassigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.

Our ATOL Number is 5111.

When you buy a package holiday that does not include a flight, protection is provided by way of a bond held by ABTA - The Travel Association, 30 Park Street, London, SE1 9EQ. For further information please see: www.abta.com.

ABTA

The Ultimate Travel Company is a Member of ABTA, membership number W0745. We are obliged to maintain a high standard of service to you according to ABTA's Code of Conduct. We can also offer you ABTA's scheme for the resolution of disputes which is approved by the Chartered Trading Standards Institute. If we can't resolve your complaint, go to www.abta.com to use ABTA's simple procedure. Further information on the Code and ABTA's assistance in resolving disputes can be found on www.abta.com.

These villa conditions apply only to the accommodation element. The Package Terms take priority if there is any conflict for package bookings.

2. Making a booking and payment

A booking is confirmed when:

• You ask us to proceed.
• You pay the required deposit.
• We issue a Booking Confirmation.

A binding contract then exists between you and the owner of the villa. Ultimate Villas acts as agent on behalf of the villa owner.

The standard deposit is 30 percent of the total rental cost and is non-refundable.
The balance is due 10 weeks (70 days) before arrival.
For bookings made within 10 weeks of arrival, the full amount is due at the time of booking.

All bank charges are your responsibility. Failure to pay the balance on time may result in cancellation and the cancellation charges in section 5 will apply.

3. Insurance

Comprehensive travel insurance is a condition of booking. Your policy should cover cancellation, curtailment, medical treatment and repatriation, personal liability, loss of personal belongings and damage to the property. Travelling without adequate insurance is entirely at your own risk.

4. Prices and what is included

The price includes:

• Exclusive rental of the villa for the confirmed dates.
• Standard utilities unless otherwise specified.
• Linen and towels.
• Housekeeping as stated in the villa description.
• Local taxes and charges specifically noted as included.
• Access to a local contact for assistance.

The price does not include:

• Flights, transfers or transport.
• Travel insurance.
• Additional housekeeping, chefs, childcare or concierge services.
• Heating, air conditioning or pool heating where charged separately.
• Tourist or occupancy taxes payable locally.
• Telephone, internet or streaming charges.
• Any services booked directly with third-party suppliers.

Villa rental prices may change before you book. The price confirmed at the time of booking and shown on your Booking Confirmation is the final price you will pay.

5. Changes or cancellation by you

5.1 Changes requested by you
Requests must be made in writing. We will help where possible. Minor changes may incur a £50 amendment fee plus any costs imposed by suppliers. Significant changes may be treated as a cancellation and rebooking.

5.2 Transfer of booking
You may request to transfer your booking to another person who meets all booking conditions. Written notice must be given at least seven days before arrival. Both parties will be jointly responsible for all costs. Airline tickets may not be transferable.

5.3 Cancellation by you
If you cancel, the Lead Guest must notify us in writing. Cancellation charges apply from the date written notice is received.

71 days or more before arrival: loss of deposit.
70 days or fewer: 100 percent of the total cost.

If stricter terms apply for a particular villa or season, these will be confirmed before booking.

5.4 Unavoidable and extraordinary circumstances
Additional cancellation rights apply only to package bookings. These are explained in the Package Terms.

6. Changes or cancellation by us

6.1 Minor changes
Minor changes to facilities or services may occur. We will notify you as soon as reasonably possible. No compensation is payable for minor changes.

6.2 Significant changes or cancellation
If we make a significant change to your villa booking or cancel it for reasons other than your fault, you may choose:

• An alternative villa of a similar standard.
• Another available holiday.
• A full refund of all monies paid if no suitable alternative is available.

Compensation rights for package bookings are set out in the Package Terms.

6.3 Force majeure
We will not pay compensation where changes or cancellations arise from events outside our control that could not have been avoided even with all reasonable care. These may include war, terrorism, serious health risks, natural disasters, industrial action, major utility failures or legal restrictions.

7. Security deposit

A refundable security deposit may be required. The amount and how it is held will be shown on your Booking Confirmation.

Deductions may be made for:

• Damage to the property or its contents.
• Additional cleaning.
• Unpaid local charges or services.
• Breach of house rules.

If no claim is made, the deposit will be released or refunded within a reasonable period after departure. If the cost of damage exceeds the deposit amount, the additional cost must be paid by you.

8. Villa information and house rules

Villa descriptions are provided in good faith but may change. Furnishings, layouts and facilities can differ slightly from photographs but the overall standard will be similar.

Owner-supplied house rules or property-specific conditions form part of your contract. By paying your deposit you confirm acceptance of both these Booking Conditions and any villa-specific rules.

9. Your responsibilities during your stay

• You are responsible for the behaviour of your entire party.
• The maximum occupancy of the villa must not be exceeded.
• Check-in is normally between 16:00 and 19:30. Check-out is normally by 10:00 unless specified otherwise.
• You must keep the villa and its contents in good condition and leave it reasonably clean and tidy.
• Smoking inside the villa and pets are not permitted unless agreed in writing.
• Children must be supervised at all times, especially around pools, terraces and balconies.
• You must comply with local laws, noise rules, and waste disposal requirements.

10. Safety, pools and local conditions

Swimming pools are not supervised. Use of the pool is at your own risk.
Rural properties may include wildlife, insects, uneven ground or unmade access roads.
Local safety standards may differ from those in the UK. Guests should exercise appropriate care throughout their stay.

11. Our responsibility

For villa-only bookings, we use reasonable skill and care in selecting suitable properties. We are not responsible for any failure or improper performance caused by:

• Your own acts or omissions.
• Acts of third parties unrelated to your villa stay that were unforeseeable or unavoidable.
• Events outside our or the owner’s control.

For claims not involving death, injury or illness, our liability is limited to twice the cost of your villa booking.

For package bookings, your additional rights are set out in the Package Terms.

12. Complaints

If a problem arises during your stay, you must:

  1. Inform the owner or local representative immediately.

  2. Contact Ultimate Villas if the issue is not resolved locally.

If the matter remains unresolved, you must write to us within 28 days of returning home. Failure to follow this procedure may affect your rights as we will not have had the opportunity to resolve the issue at the time.

13. Passports, visas and health requirements

You are responsible for ensuring all party members have valid passports, visas, entry documents and required health certifications. No refund or compensation is due if you cannot travel as a result of failing to meet these requirements.

14. Law and jurisdiction

These Booking Conditions are governed by English law. Any dispute will be dealt with by the courts of England and Wales, or by the courts of Scotland or Northern Ireland if you live there.
